GENERAL CONTRACTUAL CONDITIONS

These General Conditions regulate the USE of the services offered on the websites https://www.shuttle-service-transfers.com, and https://www.shuttle-service-transfers.eu which are owned by the company AGENTE SERVICE TRANSFERS SL, whose identifying data appears in point 2 of these General Conditions of Contract.
These legal conditions are adapted to the various legal regulations related to the provision of online services, such as Law 34/2002 of July 11, on Information Society Services and Electronic Commerce (amended by Royal Decree-Law 13/2012, of March 30); Royal Legislative Decree 1/2007, of November 16, consolidated text of the General Law for the Defense of Consumers and Users; Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, and Law 44/2006 of December 29, on improving the protection of consumers and users; Royal Decree 1906/1999, of 17 December 1999, which regulates Telephone or Electronic Contracting with general conditions; Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data; the Organic Law on Data Protection and Guarantee of Digital Rights (LOPDGDD); Law 56/2007, of 28 December, on Measures to Promote the Information Society; Law 29/2009, of 30 December, which modifies the legal regime of unfair competition and advertising to improve the protection of consumers and users; Law 32/2003 General Telecommunications Law (amended by Royal Decree-Law 13/2012, of March 30).
The use of any of the services offered on this Website implies full and unreserved acceptance of each and every one of the General Conditions indicated, as well as the Legal Notice and Privacy Policy.
Users who book through the Website acknowledge that they are of legal age (18 years old). Bookings made by minors require the prior authorization of their parents, guardians, or legal representatives, who will be held responsible for the bookings made by the minors under their care. Minors must always travel accompanied by an adult passenger.
The OWNER reserves the right to modify these General Conditions, in order to adapt them to the applicable legislation in force at any given time, new case law and usual market practices.
If you disagree with all or part of these Terms and Conditions, you must refrain from continuing to use the Website and/or its services.
For any questions the User may have regarding the Terms and Conditions, they can contact the Owner using the contact details provided in point 2 of this document, or, where appropriate, using the contact form available on this website.
1. WEBSITE OWNER IDENTIFICATION

2. SERVICES OFFERED BY THE WEBSITE OWNER
The websites offer services such as “TAXI SERVICE DISTRIBUTION CENTER”.
The transport service will not be considered in any case as a package tour under the terms established by Council Directive 90/314/EEC of 13 June 1990, nor under the terms of Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Protection of Consumers and Users as well as other complementary laws, and therefore the company does not operate in any case as a travel agency.
3. SERVICE PROCUREMENT PROCESS
To access the services provided on our website, the CLIENT must follow all the steps of the online booking system, ensuring that all the data provided is correct and complete, and making the payment for the trip in full.
The CLIENT will receive an email confirming that the OWNER has received their request to contract the service, this communication being the confirmation of the transaction carried out and services contracted.
The CLIENT must print the booking confirmation to present to the driver upon pickup. If the CLIENT does not present this confirmation, the contracted service cannot be provided. We recommend printing and/or downloading this confirmation to your mobile phone or tablet and bringing with you all communications with the company, in addition to the transfer confirmation.
The information on the voucher will include the CLIENT's pick-up point and destination, with the option to book the return trip. Any changes to this or other information must be communicated by email to booking@shuttle-service-transfers.com before the service date.
The customer assumes any increase in the cost of the service due to a change in the booking. Therefore, the total cost of any additional kilometers driven, as well as any waiting time, will be added to the booking price.
The rates will be those in force at the time of the transfer, which are established by Transport by Law, being published in the Official State Gazette of the current year, including tolls and parking.
Once the contract has been formalized, the client must notify our Customer Service department of any errors detected at least 48 hours in advance of the scheduled transfer. Notifications received less than 48 hours in advance of the transfer will entitle the company to cancel the contract without penalty.
5. FEES AND PAYMENT METHOD
The price will be as shown on our website at any given time, except in cases of obvious error. If we discover an error in the price of any of the services you have booked, we will inform you as soon as possible and give you the option of reconfirming your booking at the correct price or canceling it. If we are unable to contact you, the booking will be considered canceled and you will be fully refunded for any amounts paid.
Accepted payment methods will be: Paypal, Credit or debit card, Cash and Bizum (by sending a Bizum to the mobile 680 902 962).
Credit cards will be subject to verification and authorization by the issuing bank. If the bank does not authorize the payment, the OWNER will not be responsible for the lack of service and will not be able to enter into any contract with the User.
Once the OWNER receives the User's service request through the Website, a pre-authorization will be made on the corresponding card to ensure sufficient funds are available to complete the transaction. The card will be charged when the User receives confirmation of the service provided, in the manner and, where applicable, at the location specified.
In any case, by clicking "MAKE PAYMENT," the CUSTOMER confirms and acknowledges that they are the legitimate holder of the credit/debit card. If you are not the cardholder, it is your responsibility to ensure that you have the cardholder's consent before entering any related data and that such data, when entered, is accurate.
6. CANCELLATION POLICY.
Any cancellation of service bookings must be made in writing via email to booking@shuttle-service-transfers.com.
If we receive your cancellation request more than 24 hours before the scheduled pick-up time for the transfer you wish to cancel, you will receive a full refund. No refund will be issued if you cancel less than 24 hours before the scheduled pick-up time. In this case, you will receive a cancellation confirmation email, which you can use to claim a refund from your tour operator, airline, or insurance company.
If the OWNER is forced to make any significant changes to the service conditions, or to cancel the service, they will inform the CLIENT as soon as possible, refunding the full amount paid for the contracted service.
7. EXEMPTION FROM LIABILITY
We will not be liable for any failure or delay in performing any of our obligations under a Contract that is caused by events beyond our reasonable control ("Force Majeure Event").
The OWNER is not responsible for changes, delays or cancellation of the service due to Force Majeure or any other unfavorable or unforeseen circumstance beyond the control of the drivers.
Similarly, the OWNER is not responsible for incidents that may occur during the provision of the service, unless such incidents are a direct result of negligence on the part of the OWNER.
8. BABY AND CHILD CAR SEATS
For safety reasons, we recommend using a booster seat or child seat for passengers under 12 years old or shorter than 135 cm. During the booking process, you will have the option to reserve child seats or booster seats at all our destinations. It is the CUSTOMER'S responsibility to ensure that the restraint system is compatible with the vehicle and is installed correctly, thereby releasing the driver from any liability for incidents resulting from misuse or incorrect installation of the restraint system.
All children and infants, regardless of age, will be taken into account when determining the vehicle's capacity and must therefore be included in the total number of passengers at the time of booking.
9. RESERVATIONS FOR PEOPLE WITH REDUCED MOBILITY AND WHEELCHAIRS
Transfer services for people with reduced mobility must be requested via our email address booking@shuttle-service-transfers.com. Passengers with reduced mobility must be able to access the vehicle independently or with the assistance of one of their companions.
10. TRAVEL WITH LUGGAGE AND PETS
In order to send you a vehicle that meets your needs, you must indicate at the time of booking the type of luggage you will be taking on the trip, paying the applicable fee for this item.
Our prices include one bag or suitcase per passenger (based on a maximum combined size of 158 cm, length width height) per item. All luggage must be declared at the time of booking. Smaller items that can be carried in the passenger's footrest (e.g., a laptop, small handbag, or shoulder bag) do not need to be declared. The passenger will be responsible for all additional costs if an extra vehicle is required for luggage not declared at the time of booking. Excess luggage and bulky items may incur an additional charge.
If you are traveling with your pet, you must inform us when making your reservation. Pets must travel in their carrier, with the exception of guide dogs.

11. NULLITY
If any of these Conditions are declared null and void by a final decision issued by a competent authority, the remaining clauses will remain in force, without being affected by said declaration of nullity.
12. COMPLAINTS AND CLAIMS
The CLIENT may send the OWNER their complaints, claims or any other comments they wish to make through the contact details provided in section 2 of these Conditions.
Furthermore, the OWNER has official complaint forms available to consumers and users, which they can request from the OWNER at any time, using the contact details provided in section 2 of these Terms and Conditions.
Furthermore, if a dispute arises from this purchase agreement between the OWNER and the CLIENT, the User, as a consumer, may request an out-of-court dispute resolution, in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes. 13. APPLICABLE LAW AND JURISDICTION
Access, browsing and/or use of this Website and contracts for the purchase of services and/or products through it will be governed by Spanish law.
Any controversy, problem or disagreement arising from or related to access, browsing and/or use of the Website, or to the interpretation and execution of these Conditions, or to sales contracts between the OWNER and the User, will be subject to the non-exclusive jurisdiction of the Spanish Courts and Tribunals.
